Request for Student Reading Instruments, Kindergarten and Grades 1-2

Description. The Texas Education Agency (TEA) is notifying publishers that reading diagnostic instruments (English and Spanish) for students in Kindergarten (Texas Education Code (TEC), §28.006(c-2)) and Grades 1-2 (TEC, §28.006(c)) may be submitted for review to become commissioner-approved reading instruments for use in Kindergarten and/or Grades 1-2 starting in the 2025-2026 school year. The 2025-2029 commissioner-approved alternative Kindergarten reading instrument and the 2025-2029 Commissioner's List of Approved Grades 1-2 Reading Instruments will be available in the spring 2025 so that school districts and open-enrollment charter schools may order instruments for implementation starting in the 2025-2026 school year. Instruments selected for the commissioner's lists will remain on the lists for a minimum of four school years.
Publishers, including those on the current Commissioner's Lists of Reading Instruments, will be responsible for submitting instruments they wish to have considered to be selected as the 2025-2029 commissioner-approved alternative Kindergarten reading instrument and/or for inclusion on the 2025-2029 Commissioner's List of Approved Grades 1-2 Reading Instruments.
TEA will only accept reading instruments that are based on scientific research concerning reading skills development and reading comprehension and provide for diagnosing the reading development and comprehension of students. See the TEA Criteria for the Evaluation of English and Spanish K-2 Reading Instruments section of this notice for further information on the selection criteria.
Kindergarten and Grades 1-2. TEC, §28.006(b) and (b-1), authorizes the commissioner of education to develop a list of approved reading instruments for school districts and open-enrollment charter schools to use in the diagnosing of student reading development and comprehension. In accordance with TEC, §28.006(c) and (c-2), each school district and open-enrollment charter school is required to administer at the Kindergarten, first, and second grade levels a reading instrument adopted by the commissioner to every student. A reading instrument administered to Kindergarten students must be one of the two reading instruments identified by the commissioner (TX-KEA or the alternative instrument selected through this process). A reading instrument administered to students in Grades 1 and 2 may be selected from the list of reading instruments identified by the commissioner through this process or an alternate selected through a district-level committee.
TEA Criteria for the Evaluation of English and Spanish K-2 Reading Instruments
1. The instrument must be intended for use in Kindergarten and/or Grades 1-2, allow for progress monitoring, and must be in alignment with the Texas Essential Knowledge and Skills (TEKS). Progress monitoring refers to relatively brief measures that are conducted on a routine basis to provide information on what children are learning and rates of improvement across the academic year. This knowledge should allow teachers to determine what children are learning and adapt their curricular activities and instructional approaches to be more responsive to children's needs. All submitted instruments should allow for assessment a minimum of three times throughout the school year (i.e., beginning, middle, and end of year).
2. Submitted instruments must be considered standardized assessments. This means the instrument measures skills using common sets of questions, tasks, and materials that are administered and scored in a consistent manner. The instrument must also be reliable and valid and meet all applicable psychometric requirements outlined in this notice.
3. Submitted instruments must consist of both English and Spanish versions. English and Spanish versions must assess the same domains and skills within each domain, unless differentiated based on specific differences outlined in the English and Spanish TEKS. Spanish version of the reading instrument must be linguistically authentic (e.g., not simply a translation of the English version). In addition, the psychometric requirements listed in this notice must be provided for both English and Spanish versions of the instrument. Instruments in English and Spanish should be submitted separately using a separate form for each language assessment.
4. To be considered for review, reading instruments must provide for diagnosing the reading development and comprehension of students and assess all required skills listed in Table 1. Required skill sets based on TEKS in the Call for Submissions Informational Packet.

5. The instrument must provide a separate score for each skill set measured as outlined in Table 1: Required Skills Sets based on TEKS.
6. The instrument must be individually administered and provide estimated administration and scoring times.
7. Administration and interpretation of the instrument by a classroom teacher must be allowable and feasible. Specifically, the qualifications for those who administer and interpret the instrument (as specified in publisher's guidelines) should be within the coursework and/or licenses typically completed by certified teachers in Texas public schools. Administration procedures requiring extensive timing, the establishment of a basal and ceiling, complex judgments, and/or subjective ratings that require the special training of a diagnostician are not considered feasible for teacher administration. Initial training to teachers regarding the administration of the instrument must be made available to staff and include additional or ongoing support options available to districts for the successful implementation of the instrument.
8. The instrument must allow for screening of dyslexia at Kindergarten and/or Grade 1 level. For Kindergarten, the instrument must allow for the screening for dyslexia at the end of academic year. In accordance with the Dyslexia Handbook adopted in rule by the State Board of Education (SBOE), both the English and Spanish versions of the instrument must assess: (1) letter sound knowledge or letter naming fluency; and (2) phonological awareness. For Grade 1, the instrument must allow for the screening of dyslexia by January 31 of the academic year. In accordance with the Dyslexia Handbook adopted in rule by the SBOE, both the English and Spanish versions must assess: (1) word reading accuracy or fluency; and (2) phonological awareness. The dyslexia screeners must only take a brief time to administer.
9. If the instrument is norm-referenced, it must have a representative norming sample in terms of the sample size and the groups represented. Norm-referenced instruments must be representative of the population of Texas students in the grade(s) (Kindergarten and Grades 1-2) or at the age(s) for which the instrument is intended.
10. Criterion-referenced decisions about criterion mastery, non-mastery, risk, and impairment have special requirements for reliability and validity (see the following guidelines 11 and 12).
11. At a minimum, an instrument must possess adequate reliability as demonstrated by independent research. For instruments built using classical test theory, reliability data/information should include, minimally, internal consistency (e.g., alpha coefficients) and alternate form and/or test-retest reliability data as appropriate for the instrument's purpose and intended use. For instruments developed using item response models, suitable psychometric data from the test development process should be submitted, including, but not limited to, the standard error of measurement, indices of item discrimination and difficulty, and total test information. Classifications resulting from criterion-referenced tests (e.g., mastery, non-mastery, risk, impairment, etc.) must be shown to be reliable. Instruments that depend on examiner ratings must demonstrate appropriate forms of inter-rater reliability.
12. Decisions based on test results must be supported by validity evidence established by independent research. Evidence of concurrent or predictive construct, content, and criterion validity (e.g., correlations with measures of similar and/or dissimilar constructs, results of confirmatory factor analyses, etc.), and discriminant and convergent validity are appropriate, depending on the purpose and intended uses of the measure. Classifications resulting from criterion-referenced tests (e.g., mastery, non-mastery, risk, impairment, etc.) must be shown to be valid and demonstrate both sensitivity and specificity. Evidence of predictive validity should be submitted for measures that claim to predict future status or the likelihood of subsequent success.
13. Normative and technical data for the instrument must be no more than 15 years old (2009 or later).
14. Instruments must allow for the generation of educator, administrator, and parent reports. Parent reports must be easy to understand and available in English and Spanish.
15. Instruments must be offered at no cost to local education agencies.
16. Instruments that have the following are preferred.
(a) Instructional resources for teachers that are aligned to/support the instrument (e.g., teacher grouping support, instructional activities targeting specific student or student group instructional needs, etc.).
(b) Instructional resources for families that are aligned to/support the instrument (e.g., family activities aligned to student needs, etc.).
(c) Instrument allows for additional monitoring of students between beginning of year, middle of year, and end of year assessment windows (i.e., response to intervention based on identified needs).
Instructions for the Submission of K-2 Reading Instruments
1. Review the Call for Submissions Informational Packet included in this notice. This packet includes the criteria used for the evaluation of the reading instruments.
2. Publishers may submit an optional Notice of Intent to Apply, available at https://tea.co1.qualtrics.com/jfe/form/SV_6SxAjlm6CJR8ogS, by 5:00 p.m. (Central Daylight Time) on November 8, 2024.
3. Complete the Request for Information (RFI) Form for K-2 Reading Instruments included in this notice - one form for English and one form for Spanish. Provide written responses to all inquiries and attach any supporting technical evidence using the prompts provided in each section. Submit the completed form with all supporting documents on the Submission of Application for K-2 Reading Instruments form, available at https://tea.co1.qualtrics.com/jfe/form/SV_82lNEbkPfvNn2vA. This form must be submitted no later than 5:00 p.m. (Central Standard Time) on Thursday, December 12, 2024.

The form must include the following information: name of submitting agency, primary contact name, primary contact email address, and primary contact phone number. The primary contact should be the individual who can be contacted in the event reviewers need to ask questions or request more information pertaining to the submission. Delays in responding to reviewers' questions may result in an incomplete review; submissions with incomplete reviews will not be considered.

Online or electronic instruments must include online access information (e.g., web address, login, password) and/or an installable copy of the software so that reviewers are able to access all student and teacher content as well as the reports generated for teachers, parents, and administrators.
5. A confirmation of receipt of all required materials will be emailed to the contact email address provided.
6. Submissions that do not include all required and supporting materials (i.e., form and attachments, access information or software for online/electronic instruments) or submissions that are not received by the deadline will not be reviewed.

The petition further states that the general nature of the work proposed to be done by the District shall be (1) the purchase, design, construction, acquisition, maintenance, ownership, operation, repair, extension and improvement of a waterworks and sanitary sewer system for residential and commercial purposes; (2) the construction, acquisition, maintenance, ownership, repair, extension, operation and improvement of works, improvements, facilities, plants, equipment and appliances helpful or necessary to provide more adequate drainage for the District, and to control, abate and amend local storm waters or other harmful excesses of water; and (3) such other purchase, construction, acquisition, maintenance, ownership, operation, repair, improvement and extension of such additional facilities, including roads, parks and recreational facilities, systems, plants and enterprises as shall be consistent with all of the purposes for which the District is created. According to the petition, a preliminary investigation has been made to determine the cost of purchasing and constructing the project, and it is estimated by the Petitioner, from the information available at this time, that the cost of said project will be approximately $41,555,000 ($25,095,000 for water, wastewater and drainage, $13,505,000 for roads and $2,955,000 for recreational facilities).

The Texas Health and Human Services Commission (HHSC) announces its intent to submit amendments to the Texas State Plan for Medical Assistance, under Title XIX of the Social Security Act. The proposed amendments are effective November 1, 2024.
The purpose of this amendment is to update the fee schedules and rate methodologies in the current state plan by adjusting a fee-for-service reimbursement rate and implementing a new fee-for-service rate for Non-Emergency Medical Transportation (NEMT) Services.
The proposed amendments are estimated to result in an increase to annual aggregate expenditure of $72,803 for federal fiscal year (FFY) 2025, consisting of $43,689 in federal funds and $29,114 in state general revenue. For FFY 2026, the estimated result is an increase to annual aggregate expenditure of $88,534, consisting of $52,979 in federal funds and $35,555 in state general revenue. For FFY 2027, the estimated result is an increase to annual aggregate expenditure of $89,719, consisting of $53,679 in federal funds and $36,040 in state general revenue.

The Texas Department of Housing and Community Affairs (the Department) announces a NOFA of approximately $2,328,618 in HOME funds for single-family housing programs under the Persons with Disabilities (PWD) set-aside under a Reservation System. These funds will be made available to HOME Reservation System Participants with a current Reservation System Participation (RSP) Agreement. Funds will be available beginning Tuesday, October 29, 2024, at 10:00 a.m. Austin local time.
The availability and use of these funds are subject to the HOME rules including, but not limited to the following Texas Administrative Code (TAC) rules in effect at the time of contract execution: Title 10, Part 1, Chapter 1, Administration; Chapter 2, Enforcement; Chapter 20, the Single Family Programs Umbrella Rule; Chapter 21, the Minimum Energy Efficiency Requirements for Single Family Construction Activities; Chapter 23, the Single Family HOME Program (State HOME Rules), and Tex. Gov't Code Chapter 2306. Other federal and state regulations include but are not limited to: 24 CFR Part 58 for environmental requirements, 2 CFR Part 200 for Uniform Administrative Requirements, 24 CFR §135.38 for Section 3 requirements, 24 CFR Part 5, Subpart A for fair housing, (Federal HOME Rules), and for units of government, the Uniform Grant and Contract Management requirements as outlined in Chapter 783 in the Texas Local Government (UGMS or TxGMS, as applicable). Applicants must familiarize themselves with all of the applicable state and federal rules that govern the HOME Program.
Eligible Activities
Homeowner Reconstruction Assistance (HRA). HRA provides funds for the rehabilitation, reconstruction, or new construction of a single-family residence owned and occupied by eligible low-income Households. Specific program guidelines can be found at 10 TAC Chapter 23, Single Family HOME Program, Subchapter C, Homeowner Reconstruction Assistance Program, §§23.30 - 23.32.
Tenant-Based Rental Assistance (TBRA). TBRA provides rental subsidies to eligible low-income Households. Assistance may include rental, security, and utility deposits. Specific program guidelines can be found at 10 TAC Chapter 23, Single Family HOME Program, Subchapter F, Tenant-Based Rental Assistance Program, §§23.50 - 23.52.
Eligible Applicants include Units of General Local Government, nonprofit organizations, Public Housing Authorities, Local Mental Health Authorities, and Councils of Government. Funds may not be used in a Participating Jurisdiction (PJ).

The Texas Department of Housing and Community Affairs (TDHCA) was originally allocated $132,969,147 from the U.S. Department of Housing and Urban Development (HUD) under Section 3205 of the American Rescue Plan Act, which is called the HOME-ARP Program. The draft Second Amendment to the HOME-ARP Allocation Plan reflects updated programming of funds for activities due to a reduction of $3,808,153 due to a HUD allocation error and a reallocation of $4,317,058 from areas in Texas that did not program their HOME-ARP funds
This notice contains information on the draft Second Amendment to the HOME-ARP Plan that was approved by the TDHCA Governing Board on October 10, 2024, and dates for a 15-day public comment period on the amendment. The public comment period will be held from Monday, October 14, 2024, to 5:00 p.m. Austin local time on Monday, October 28, 2024. Comments received after 5:00 p.m. Austin local time on October 28, 2024, will not be accepted. Request for Proposals for FRA Corridor ID
The North Central Texas Council of Governments (NCTCOG) is requesting written proposals from consultant firms to assist NCTCOG in completing Step 1 of the Federal Railroad Administration’s (FRA’s) Corridor Identification and Development (Corridor ID) process. NCTCOG specifically needs technical project assistance and advisory services for the completion of the primary deliverables of Step 1. Fulfilling these deliverables, as specified in NCTCOG’s Grant Agreement with the FRA, is required to move forward to Corridor ID Step 2, where NCTCOG will develop the Service Development Plan for the Corridor. Successful navigation of the Corridor ID process will position this project to be eligible for future funding through FRA’s national Federal State Partnership program.
Proposals must be received in-hand no later than 5:00 p.m., Central Time, on Friday, November 22, 2024, to Brendon Wheeler, Program Manager, North Central Texas Council of Governments, 616 Six Flags Drive, Arlington, Texas 76011 and electronic submissions to TransRFPs@nctcog.org. Notice of a Public Comment Hearing on an Application for a Sand and Gravel Permit
Real County/Citizens of Real County Partnership have applied to the Texas Parks and Wildlife Department (TPWD) for a General Permit pursuant to Texas Parks and Wildlife Code, Chapter 86, to remove or disturb 50 cubic yards of sedimentary material within the Frio River in Real County. The purpose is the extension of an existing low water crossing on County Road Camino Bajo. The location is on County Road Camino Bajo approximately 1/10 mile west of the intersection of County Road Camino Bajo and County Road Camino Alto in Real County. The Latitude/Longitude is 29.725097, -99.747989. This notice is being published and mailed pursuant to 31 TAC §69.105(d).
TPWD will hold a public comment hearing regarding the application at 10 a.m. on November 15, 2024, at TPWD headquarters, located at 4200 Smith School Road, Austin, Texas 78744. A remote participation option will be available upon request.
